Terms of Service
These Terms of Service set out, in plain language, the rules that apply when you browse themineralslab.com or order Cutting Drops from us, and the rights you keep under the consumer protection laws of Australia, the United States, the United Kingdom, Canada and New Zealand. Please read them before placing an order.
Agreement To These Terms
Welcome to The Minerals Lab, a registered trading name of URBAN CLOTHING PTY LTD (ABN 78 671 782 111), a company registered in Queensland, Australia. Throughout these Terms, "we", "us" and "our" mean URBAN CLOTHING PTY LTD trading as The Minerals Lab, and "you" means anyone who visits themineralslab.com or places an order with us.
By visiting our website, creating an account, or placing an order for Cutting Drops, you agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy, our Return & Refund Policy, our Subscription & Cancellation Policy and our Legal Notice, each of which is incorporated into, and forms part of, these Terms. Together, these documents are the entire agreement between you and us regarding your use of our website and any order you place. If you do not agree with any part of these Terms, please do not use themineralslab.com or place an order.
Nothing in these Terms overrides your statutory rights. Where any clause in this document conflicts with a consumer protection right that cannot lawfully be excluded, limited or waived in your country of residence, the stronger statutory protection governs. Section 17 explains this in detail, and Section 18 sets out the specific rights that apply depending on where you are shopping from.
Eligibility & Age Requirement
Cutting Drops is a wellness supplement intended for adults, and our website and checkout are not directed at, or designed for, children. By placing an order or creating an account, you represent and confirm that:
- you are at least 18 years of age, or the age of majority in your jurisdiction if that age is higher;
- you have the legal capacity to enter into a binding contract with us;
- the billing and shipping information you provide is accurate, current and belongs to you or a person who has authorised you to use it; and
- you are ordering Cutting Drops for your own personal use, or as a genuine, occasional gift, and not for resale (see Section 06).
We do not knowingly sell to, or collect personal information from, anyone under 18. If we become aware that an order has been placed by, or on behalf of, a person under the required age, we may cancel that order and refund any payment received, in line with the U.S. Children's Online Privacy Protection Act (COPPA) and equivalent protections in Australia, the United Kingdom, Canada and New Zealand.
Who These Terms Apply To
We currently accept orders for delivery to five countries only: Australia, the United States, the United Kingdom, Canada and New Zealand. If your delivery address is outside these five countries, please do not place an order — we are unable to fulfil it, and it may be cancelled and refunded under Section 06.
These Terms are written and published in English. Where a translated version of this page is ever made available, the English-language version is the version that governs in the event of any inconsistency, except where local law requires otherwise (for example, contract-language rights available to consumers in the Province of Québec, described in Section 18).
Our Product & Description Accuracy
We currently sell one product: Cutting Drops, a liposomal botanical formula combining ten concentrated plant extracts — including ginger, fennel, peppermint, dandelion and burdock root — traditionally used to support digestive comfort, everyday bloating relief and the body's natural detox and lymphatic flow. We describe Cutting Drops, its ingredients and its intended use as accurately as we can on our product page, and we update that page whenever a material change is made to the formula, ingredient list or packaging.
Natural batch variation
Cutting Drops is made from botanical, plant-derived extracts. Colour, consistency, aroma and taste can vary slightly from batch to batch as a natural result of using real plant material, without affecting the labelled formulation or dosage of the product.
Images are representative
Product photography, packaging renders and bottle labelling shown on our website are representative of the product you will receive. Minor differences in label design or bottle appearance may occur between production runs.
Individual results vary
Any description of how Cutting Drops may support digestion, bloating or everyday comfort reflects the traditional use of its botanical ingredients. Individual experiences differ, and we do not guarantee that any specific result will occur for any individual customer.
Health, Medical & Regulatory Disclaimer
Cutting Drops is a botanical wellness supplement. It is not a medicine, not a registered therapeutic good, and not intended to diagnose, treat, cure or prevent any disease or medical condition. Nothing on themineralslab.com, in our marketing, or in customer reviews and testimonials, is intended as medical advice, and none of it should be relied upon as a substitute for advice from a qualified physician, pharmacist or other healthcare professional.
Statements about Cutting Drops have not been evaluated by the U.S. Food and Drug Administration (FDA), Australia's Therapeutic Goods Administration (TGA), the UK's Office for Product Safety and Standards / MHRA, Health Canada, or New Zealand's Medsafe. Cutting Drops is not listed or registered as a therapeutic good, and we do not represent it as one.
If you are pregnant, breastfeeding, under 18, taking prescription or over-the-counter medication, or managing an existing medical condition, speak with your doctor or pharmacist before use. Discontinue use and seek medical advice if you experience any adverse reaction.
Customer reviews, testimonials and before/after descriptions published on our website or social channels reflect the personal, subjective experience of the individual who wrote them. They are not clinical evidence, are not independently verified by us for medical accuracy, and should not be read as a guarantee that you will experience the same result. Placing An Order, And Our Right To Refuse An Order
When you place an order, you are making an offer to buy Cutting Drops on these Terms. Our acceptance of that offer happens when we send you an order confirmation email; a payment receipt or automated confirmation is not, by itself, our acceptance of your order. Until we send that confirmation, we may decline or cancel an order, in which case any payment taken will be refunded in full.
We may refuse, limit, cancel or suspend an order, an account, or access to our website, acting reasonably and where permitted by law, if we suspect any of the following:
- the order appears to be fraudulent, or payment cannot be authorised or verified by our payment processor;
- the order is intended for resale, wholesale distribution, or commercial redistribution rather than personal use — we sell Cutting Drops directly to consumers, and buying direct from The Minerals Lab is the only way we can guarantee authenticity and freshness;
- the delivery address falls outside Australia, the United States, the United Kingdom, Canada or New Zealand, or in a region we are otherwise unable to ship to safely or lawfully;
- the order was placed in breach of these Terms, or by someone we have previously suspended for abuse of our returns, refund or promotional terms; or
- a pricing, stock, or product description error occurred on our website or in an advertisement — in which case we will contact you before processing payment or dispatch, and you may cancel the order for a full refund.
Pricing, Currency & Taxes
All prices on themineralslab.com are set and recorded in Australian dollars (AUD), our home currency, inclusive of Australian GST where GST applies. If you are shopping from the United States, the United Kingdom, Canada or New Zealand, our storefront may display an estimated converted price in your local currency for convenience.
- Converted prices are estimates only. The amount actually charged to your card or payment account may differ slightly due to exchange-rate movements between the time you view the price and the time your payment is processed.
- Your bank, card issuer or payment provider may apply its own foreign currency conversion fee or international transaction fee. These fees are set by your financial institution, not by us, and are not included in the price shown at checkout.
- International orders (to the United States, the United Kingdom, Canada or New Zealand) may be subject to customs duties, import taxes, or handling fees charged by your destination country. These charges, if any, are set by your local customs authority, are the responsibility of the customer, and are not collected by us at checkout or included in our displayed prices.
- We take reasonable care to ensure prices on our website are accurate, but if a genuine pricing error occurs, Section 06 explains what happens next.
Payment Terms
Payment is due in full at the time you place your order, unless you have chosen a recurring subscription order under Section 09. We accept the following payment methods, processed securely through Shopify's PCI-DSS-compliant checkout infrastructure and, where selected, PayPal:
- We do not receive, view or store your full card number, expiry date or security code — these are handled entirely within Shopify's and PayPal's own secure payment systems.
- By submitting an order, you confirm that you are authorised to use the payment method provided, and you authorise us (or our payment processor) to charge that payment method the total order amount, including shipping, in accordance with these Terms.
- If a payment is declined, reversed, or subject to a chargeback that we reasonably believe to be unwarranted, we may suspend fulfilment of the related order and, where permitted by law, of any account associated with it, until the matter is resolved.
Subscription & Recurring Orders
Where our checkout offers you the option of a recurring, subscription-style delivery of Cutting Drops rather than a single one-time purchase, choosing that option means you are agreeing to a recurring, deferred or negative-option purchase, on top of these Terms. Before you confirm a subscription order, we will clearly show you the price per delivery, the delivery frequency, and how to cancel. Full detail on how our subscriptions work, how billing dates are set, and how to skip, pause or cancel a subscription is set out in our Subscription & Cancellation Policy, which forms part of these Terms.
How we keep subscriptions fair and transparent
- United States: we comply with the FTC's rules on negative-option marketing, including the Restore Online Shoppers' Confidence Act (ROSCA), and with applicable state automatic-renewal laws (including California's Automatic Renewal Law), by disclosing the recurring charge clearly before you pay and providing a simple way to cancel.
- United Kingdom: we provide the pre-contract information required for subscription contracts under the Consumer Rights Act 2015 and related consumer protection law, and we do not make cancellation harder than sign-up.
- Canada: we obtain your express, opt-in consent before starting any recurring charge, in line with federal and provincial consumer protection law, including Québec's Consumer Protection Act rules on negative-option billing and Ontario's Consumer Protection Act, 2002.
- Australia: our subscription terms are presented clearly at the point of sale in line with the Australian Consumer Law's protections against unfair and unsolicited consumer agreements.
- New Zealand: our subscription terms are presented in a way that is not misleading or deceptive, consistent with the Fair Trading Act 1986.
You can cancel a recurring order at any time before your next scheduled charge by emailing help.themineralslab@gmail.com or by following the cancellation steps in our Subscription & Cancellation Policy. Cancelling stops future charges; it does not automatically entitle you to a refund of a delivery already charged and dispatched, which is instead handled under Section 11.
Shipping & Delivery
Full shipping detail, including tracking and lost-parcel handling, is set out in our Shipping Policy, which forms part of these Terms. In summary:
You will receive a tracking number by email once your order is dispatched. Delivery estimates are provided in good faith based on information from our couriers and are not guaranteed delivery dates; they can be affected by customs processing, remote delivery addresses, or events outside our control.
Returns, Refunds & Cancellations
We want you to feel confident ordering from us. On top of the statutory rights described in Section 18, we offer:
30-calendar-day return window
You have 30 calendar days from the date of delivery to request a return.
10-business-day refund processing
Once your return is approved and received, we process the refund to your original payment method within 10 business days.
Full eligibility criteria, how to start a return, and how our 30-day money-back guarantee is applied are set out in our Return & Refund Policy, which forms part of these Terms. If you are shopping from the United Kingdom, you also have a statutory right to cancel most online orders within 14 days under the Consumer Contracts Regulations, independently of our 30-day guarantee — see Section 18.
Intellectual Property
Everything you see on themineralslab.com — including the "The Minerals Lab" and "Cutting Drops" names and logos, our product formulations, packaging design, photography, video, written content, and the layout and code of our website — is owned by, or licensed to, URBAN CLOTHING PTY LTD, and is protected by copyright, trade mark and other intellectual property laws in Australia, the United States, the United Kingdom, Canada, New Zealand and internationally.
You may view, download and print pages from our website for your own personal, non-commercial use. You may not reproduce, republish, distribute, modify, reverse-engineer, or create derivative works from any part of our website or branding, or use our name, logo or product imagery in your own advertising, without our prior written consent.
Reviews & User-Generated Content
If you submit a product review, testimonial, photo, or other content to us (for example, through our review platform or by email), you confirm that it reflects your own genuine, honest experience with Cutting Drops, that you have the right to submit it, and that it does not infringe anyone else's rights. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce and use that content on themineralslab.com and in our marketing, with attribution to your first name and general location where shown.
- Reviews are moderated before publication. We do not fabricate reviews or pay for reviews that misrepresent a reviewer's genuine experience.
- We may edit review content for length, formatting or to remove unlawful, defamatory, offensive or medically unsubstantiated claims, without changing its overall meaning, and we may decline to publish, or remove, any content at our discretion.
- Reviews and testimonials describe individual, subjective outcomes. As explained in Section 05, they are not medical evidence and results will vary between individuals.
Acceptable Use Of This Website
When using themineralslab.com, you agree not to:
- use our website for any unlawful purpose, or in a way that breaches the rights of others;
- attempt to gain unauthorised access to our systems, interfere with our website's security, or introduce malicious code;
- scrape, copy or systematically extract our content, pricing or product data for a competing commercial purpose;
- place fraudulent orders, use stolen payment details, or otherwise misuse our checkout, promotional codes or return process; or
- impersonate any person or entity, or misrepresent your affiliation with us.
We may suspend or terminate your access to our website or your account if we reasonably believe you have breached this section.
Third-Party Links & Services
Our website relies on third-party services to operate — including Shopify (our e-commerce platform), Shopify Payments and PayPal (payment processing), and the couriers that deliver your parcel — and may occasionally link to other third-party websites, such as social media platforms. We are not responsible for the content, accuracy, or practices of any third-party website or service, and your use of them is governed by that third party's own terms. Once you leave themineralslab.com, these Terms no longer apply.
Limitation Of Liability & Indemnity
To the fullest extent permitted by law, and subject always to the non-excludable statutory guarantees described in Section 18, URBAN CLOTHING PTY LTD, its officers, employees and contractors will not be liable to you for any indirect, incidental, special or consequential loss, or for loss of profits, arising from your use of themineralslab.com or your purchase of Cutting Drops. Our total liability to you for any claim arising out of an order will not exceed the amount you actually paid for the relevant order.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud, or for a breach of a consumer guarantee under the Australian Consumer Law, the UK Consumer Rights Act 2015, U.S. state consumer protection law, Canadian consumer protection law, or the New Zealand Consumer Guarantees Act.
You agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of our website, or your violation of any law or the rights of a third party — except to the extent that claim arises from our own negligence, breach of these Terms, or breach of a non-excludable consumer guarantee.
Governing Law, Dispute Resolution & Your Statutory Rights
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles, and — subject to the paragraph below — the courts of Queensland have non-exclusive jurisdiction over any dispute arising from these Terms.
This does not take away your local consumer rights
Choosing Queensland law to govern our contract does not remove, reduce or override any consumer protection right that the law of your own country or state makes non-excludable — including your rights under the Australian Consumer Law (ACL), the UK Consumer Rights Act 2015, applicable U.S. federal and state consumer protection law, Canadian federal and provincial consumer protection legislation, and the New Zealand Consumer Guarantees Act 1993. Where this clause conflicts with any such non-excludable right, the stronger, non-excludable protection applies.
Resolving a dispute: if a disagreement arises, please contact us first at help.themineralslab@gmail.com — we aim to resolve most concerns directly within a few business days. If we cannot resolve a dispute informally, either party may refer the matter to binding arbitration or, where you prefer, to the small claims court or consumer tribunal available in your own country under Section 18, before pursuing court proceedings in Queensland. Nothing in this section prevents you from lodging a complaint with a consumer regulator listed in Section 18, or from exercising any right to bring a claim in your local courts that cannot be waived under your local law.
Your Consumer Rights, By Country
Open the section for the country you are shopping from to see the statutory rights that apply to you, on top of the promises we make in Section 11.
AustraliaOur goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have Cutting Drops repaired or replaced if it fails to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits or excludes these ACL guarantees, or the additional protections against unfair contract terms and unsolicited consumer agreements. If you believe we have breached the ACL, contact us first, and if unresolved, you may contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or Queensland's Office of Fair Trading.
Depending on your state of residence, you have consumer protections under the Federal Trade Commission Act (which prohibits unfair or deceptive practices and unauthorised negative-option billing under ROSCA), the FTC's Mail, Internet, or Telephone Order Merchandise Rule (which governs shipping-time representations), state consumer protection statutes, and, where applicable, the implied warranty of merchantability under your state's adoption of the Uniform Commercial Code and the Magnuson-Moss Warranty Act.
These Terms do not remove any right or remedy available to you under federal or state law that cannot be waived by agreement. If you believe we have violated a consumer protection law, you may contact the Federal Trade Commission at reportfraud.ftc.gov or your state Attorney General's office.
Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose and as described. If Cutting Drops does not meet this standard, you may be entitled to a repair, replacement, price reduction or refund, depending on how soon the problem is discovered.
Separately, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you generally have the right to cancel most online orders within 14 days of delivery without giving a reason, and to a refund within 14 days of us receiving the returned goods or evidence of return. This 14-day statutory right exists alongside, and does not reduce, our 30-day return guarantee in Section 11.
Nothing in these Terms limits these rights. If unresolved, you may contact the Citizens Advice consumer service or the Chartered Trading Standards Institute at tradingstandards.uk.
You have protections under federal law (including the Competition Act's prohibition on false or misleading advertising and the Consumer Packaging and Labelling Act) and under the consumer protection legislation of your province or territory, such as Ontario's Consumer Protection Act, 2002, which gives you rights around internet agreements and, in some circumstances, a cancellation period if required disclosures are not provided.
If you are a resident of Québec, you have the right to receive this agreement, and to communicate with us, in French, under Québec's Consumer Protection Act and the Charter of the French Language. Please email us if you would like a French-language version of these Terms or our policies.
Nothing in these Terms limits these rights. If unresolved, you may contact the Office of Consumer Affairs (Innovation, Science and Economic Development Canada) or your provincial consumer protection office, such as the Office de la protection du consommateur in Québec.
Under the Consumer Guarantees Act 1993, Cutting Drops must be of acceptable quality, fit for its intended purpose, and match its description. If it does not, you may be entitled to a repair, replacement or refund, depending on whether the failure is minor or significant.
Under the Fair Trading Act 1986, we must not engage in misleading or deceptive conduct, or make false representations about Cutting Drops, our pricing, or our subscription terms.
Nothing in these Terms limits these rights. If unresolved, you may contact the Commerce Commission at comcom.govt.nz or Consumer Protection at consumerprotection.govt.nz.
Severability & Changes To These Terms
If any provision of these Terms is found by a court or regulator to be invalid, illegal, or unenforceable in a particular jurisdiction, that provision will be limited or removed to the minimum extent necessary in that jurisdiction only, and the remaining provisions of these Terms will continue in full force and effect.
We may update these Terms from time to time to reflect changes in our products, business practices, service providers, or the law. When we make a material change, we will update the "last updated" date at the top of this page, and, where required by law, notify existing subscription customers before the change takes effect. Your continued use of themineralslab.com, or placement of a new order, after a change takes effect means you accept the updated Terms; changes will not apply retroactively to an order you placed before the change.
